Terms and Conditions for Alkebulan Africa

Welcome to Alkebulan Africa. These Terms and Conditions (“Terms”) govern your use of our services, website, and the properties listed on our platform. By booking a stay or using our platform, you agree to these Terms.
1. Definitions
- "Alkebulan Africa", "we", "us", or "our" refers to Alkebulan Homes and Villas Ltd.
- "Guest", "you", or "your" refers to any person who makes a booking or stays at a property.
- "Host" refers to the property owner or authorized manager listed on our platform.
- "Property" means the accommodation made available to guests.
- "Platform" refers to our website, app, or any system used to manage bookings.
- “Homeowner” refers to the owner of the property.
2. Booking and Payment
- All bookings are subject to availability and confirmation.
- Bookings can be made via our website, mobile platforms, or authorized agents.
- Guests must provide accurate personal details, including valid contact information and identification (National ID for domestic guests or Passport for international guests).
- Full or partial payment may be required at the time of booking. Accepted payment methods include bank transfer, M-Pesa, credit/debit card, or any method listed on our platform.
- Alkebulan Africa reserves the right to cancel bookings with incomplete or unverifiable information.
3. Check-In and Check-Out
- Check-in time: From 15:00
- Check-out time: By 11:00
- Early check-in or late check-out may be offered upon request and is subject to availability and additional charges.
4. Identification and Guest Verification
- The lead guest must complete ID verification via our trusted third party partner TRUVI via the link sent at the time of reservation.
- All guests must present a valid national ID or Passport via online check-in.
- The booking guest must be at least 18 years old.
- Guests must ensure their information matches the booking records and that all details of guests staying in the property are correctly recorded.
5. Guest Responsibilities and House Rules
Guest must:
- Comply with all house rules, property-specific instructions, and local laws.
- Treat the property with care and avoid damage or misuse.
- Refrain from any illegal, disruptive, or unsafe behavior on the premises.
- Respect quiet hours and neighborhood guidelines.
- Not exceed the stated occupancy limits without prior approval.
- Not host parties or events without written permission from Alkebulan Africa or the Host.
Failure to comply may result in eviction with partial or no refund and possible legal liability.
6. Cancellations and Refunds
Cancellation by Guest:
- Cancellations must be made in writing or via our platform.
Our standard policy is:
- Full refund if cancelled [30-15 days] before check-in.
- Partial refund if cancelled [14-2 days] before check-in.
- No refund if cancelled less than [2 days] before check-in or for no-shows.
Cancellation by Alkebulan Africa or Host:
- We may cancel a booking in case of unforeseen circumstances, force majeure, safety issues, or fraud. In such cases, you may be offered:
- A full refund
- An alternative property of equal or better value.
7.Security Deposit and Damages
- Certain properties may require a refundable security deposit.
- Guests are liable for any damage, loss, or excessive cleaning costs resulting from their stay in the event that such damage exceeds the cover provided by TRUVI.
8. Property Access and Use
- The Host or authorized personnel may access the property during your stay in emergencies or for urgent maintenance, with prior notice when possible.
- The property is provided for residential use only. Commercial use or subletting is prohibited.
9. Liability and Disclaimers
Alkebulan Africa is not liable for:
- Personal injury, theft, or loss of guest belongings.
- Utility interruptions (e.g., electricity, water) beyond our control.
- Acts of God or force majeure events.
Guests should ensure they have appropriate travel insurance.
10. Data Protection and Privacy
We process your personal data in accordance with our Privacy Policy and both the General Data Protection Regulation (GDPR) and Kenya Data Protection Act, 2019.
11. Force Majeure
We are not liable for failure to perform any obligation if such failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, civil unrest, or government actions.
12. Intellectual Property
All content on our platform, including logos, images, text, and software, is the property of Alkebulan Africa or its licensors. You may not use, reproduce, or distribute this content without our written consent.
13. Termination of Stay
We reserve the right to terminate a booking or guest stay without notice if:
- There is a breach of these Terms.
- The safety or well-being of others is at risk.
- Fraudulent or unlawful activity is suspected.
No refund will be issued in such cases.
14. Dispute Resolution
Any disputes will be resolved as follows:
- Initial resolution: Through customer service dialogue.
- Escalation: Referral to the Data Protection Authorities (DPAs) or Kenya Office of the Data Protection Commissioner (ODPC) whichever are responsible for resolving data protection issues .
- Governing Law: These Terms are governed by the laws of the applicable jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our platform with a revised effective date. Continued use of our services implies acceptance of the new terms.
